Delhi’s push towards vertical urban growth received a major boost after the Delhi High Court upheld the approval granted to a high-rise residential project in Vasant Kunj. Rejecting petitions filed by a residents’ welfare association and a neighbouring school, the court ruled that modern housing projects cannot be restricted by height limits that applied to older developments in the area.
The verdict comes amid increasing debate over redevelopment, housing density and the future of urban planning in the national capital, where pressure on land resources continues to grow.
Court says urban growth cannot be restricted by old norms
According to Bar and Bench, the dispute centred on a group housing project proposed in an area dominated by older Delhi Development Authority flats that are significantly shorter in height. Petitioners argued that allowing a structure nearly three times taller than surrounding buildings would alter the character of the locality and violate planning regulations requiring conformity with nearby development.
However, the High Court held that conformity does not mean every new building must replicate the exact height or design of existing structures. The court observed that Delhi’s planning framework has evolved and cannot be bound indefinitely by standards adopted decades ago.
According to the judgement, older residential developments cannot act as a permanent barrier against future redevelopment carried out under updated planning policies.

Vertical development necessary for a growing Delhi
According to Bar and Bench, the court highlighted Delhi’s unique challenges as a densely populated and land-constrained metropolis. With limited availability of developable land and a steadily rising demand for housing, planned vertical expansion has become an important part of the city’s long-term development strategy.
Referring to the Master Plan for Delhi 2021, the court noted that the policy encourages optimal use of urban land through redevelopment and group housing projects. It stressed that controlled increases in building height are necessary to accommodate population growth without expanding the city’s footprint endlessly.
The court also accepted submissions that similar multi-storey developments already exist within the broader Vasant Kunj area.

Environmental and civic concerns rejected
According to Bar and Bench, residents and the neighbouring school had also raised concerns over traffic, environmental impact, construction-related disturbance and safety issues. They argued that the project could place additional pressure on local infrastructure and affect a designated silence zone.
After examining the records, the court found that the project had obtained the required statutory clearances and approvals. It concluded that no evidence of illegality, arbitrariness or violation of planning regulations had been established.
